Site Safety Management (WHS and SWMS)

How WHS duties, SWMS, and high-risk construction work requirements apply to Australian construction sites.

Site safety management on Australian construction sites operates under the Work Health and Safety (WHS) Act and Regulations (harmonised across most states/territories, with some variation e.g. in Victoria's OHS framework).

The central obligation is that a Person Conducting a Business or Undertaking (PCBU) must, so far as reasonably practicable, eliminate or minimise risks to health and safety.

High Risk Construction Work (HRCW)

WHS Regulations define specific categories of High Risk Construction Work requiring a Safe Work Method Statement (SWMS) before work begins:

Safe Work Method Statements (SWMS)

A SWMS documents the high-risk work activity, the hazards involved, and the control measures to be applied, and must be developed before HRCW commences and be available on site.

A compliant SWMS must:

  1. Identify the work activity and the specific HRCW category
  2. Identify hazards associated with the work
  3. Describe control measures, referencing the hierarchy of controls
  4. Describe how the controls will be implemented, monitored, and reviewed
  5. Be reviewed and, where necessary, revised if work changes or an incident occurs

PPE is the last line of defence, not the primary control: SWMS should demonstrate that higher-level controls were considered first.

Incident Notification

Certain incidents must be notified to the relevant WHS regulator immediately, including:

  • Death of a person
  • Serious injury or illness (e.g. requiring hospital admission)
  • Dangerous incidents (e.g. structural collapse, uncontrolled escape of a substance): even without injury

The site must generally be preserved until an inspector attends or directs otherwise.

Practical Notes

  • A SWMS that simply lists PPE without engineering or administrative controls will not meet the "so far as reasonably practicable" standard, and is a common audit failure point.
  • SWMS must be a live document: reviewed when conditions or methods change, not filed away once and forgotten.
  • Principal contractors carry overarching site safety coordination duties even when subcontractors manage their own crews: SWMS review and site induction records should reflect this oversight.
